Permanent residency or domicile

In order to use The Probate Wizard, the deceased must have been permanently resident or "domiciled" in England or Wales.

If the deceased lived in England or Wales all their life, with just the occasional foreign holiday, they were domiciled here. However, just being born here, living here or having British nationality is not necessarily enough.

The deceased was probably domiciled in England or Wales if he or she:

  1. Was born in England or Wales and lived here most of their life; or
  2. Moved to England or Wales many years ago and remained here; or 
  3. Intended to live in England or Wales for the rest of their life.

Domicile is not always clear-cut. If you are unsure about the deceased's domicile, you can read on the topic on the HMRC website and you may need to seek professional advice.
