How to deal with a house owned as joint tenants

It is easy to deal with a property occupied by a surviving joint tenant as part of the probate process.

You should contact the Land Registry and advise them of the death of the co-owner.

This is a simple procedure involving the Land Registry form DJP (Death of a Joint Proprietor).

The Land Registry does not need to see the grant of representation. A copy of the death certificate, along with completed form DJP, will suffice.

The Land Registry will update the register entries to show that the surviving joint tenant is now the sole surviving owner.

Unregistered land

The majority of land in England & Wales is registered. For unregistered land, the process is trickier. We recommend seeking assistance from a solicitor or other legal professional.
