What does "going to probate" mean?

If an estate is said to be "going to probate", this usually means a grant of representation is required.

The grant of representation

A grant of representation is usually a vital part of the probate process. It proves that the personal representatives have the authority to deal with the estate.

However, a grant is not always required. See our guide "Is a grant of representation required?".

"Going to probate" is not a phrase found in statute or case law, but it is a common phrase in everyday use.
