Can an executor choose not to act?

Despite being appointed by a will, an executor can choose not to administer the estate.

He or she may wish to step aside for practical reasons, perhaps because it is convenient for another executor to deal with the estate, or perhaps because they are abroad or unwell.

By default, an executor is an acting executor. To step aside he or she must renounce or have power reserved. See our guide “Renouncing and power reserved”.

Executors who have already undertaken some aspect of the probate process (“intermeddled in the estate”) may not renounce.
